A. Terms and Conditions – Apostille Services

These Terms and Conditions (“Agreement”) govern the provision of apostille and authentication services (“Services”) by East Bay Notary Express, Mobile Notary & Apostille and any affiliated entity under the East Bay Notary Express, Mobile Notary & Apostille umbrella (“company”, “we,” “us,” or “our”) to the customer (“Client,” “you”). By submitting an order or payment for Services through any of our websites or other platforms, the customer (“you” or “Client”)  agrees to be legally bound by the terms outlined below:

1. Scope of Services

1.1 The Company assists in obtaining apostilles or authentications from the Secretary of State, U.S. Department of State, and/or foreign embassies or consulates as required.
1.2 The Company is not a law firm and does not provide legal advice. Our role is limited to facilitating the processing of documents.
1.3 The Client is solely responsible for determining whether an apostille, authentication, or legalization is required for their documents.

2. Client Responsibilities

2.1 The Client must provide accurate, complete, and original documents (or properly certified copies, where applicable).
2.2 The Client is responsible for ensuring the documents meet the receiving authority’s requirements.
2.3 The Company is not liable for delays or rejections caused by incomplete, incorrect, or noncompliant documents provided by the Client.

3. Processing Times

3.1 Any quoted processing times are estimates only and may vary depending on government agencies, embassies, or other third parties.
3.2 The Company is not responsible for delays outside of its control, including but not limited to postal service interruptions, government office closures, or international shipping delays.

4. Fees and Payments

4.1 Service fees must be paid in full before submission unless otherwise agreed in writing.
4.2 All government, courier, mailing, and embassy fees are the Client’s responsibility unless specifically included in the service package.
4.3 Fees are non-refundable once the Company has begun processing the documents, even if the request is canceled or rejected.

5. Shipping and Delivery

5.1 The Company may assist with shipping arrangements but assumes no liability for loss, delay, or damage once documents are in transit via courier, mail, or third-party carriers.
5.2 The Client is encouraged to use trackable and insured delivery methods.

6. Liability Limitations

6.1 The Company’s liability is strictly limited to the amount of service fees paid by the Client.
6.2 The Company is not responsible for consequential damages, including but not limited to lost business opportunities, penalties, or personal inconvenience.

7. Privacy and Confidentiality

7.1 The Company will handle Client documents with strict confidentiality and will only disclose information when required by law or with the Client’s consent.

8. Indemnifications

8.1 You agree to indemnify, defend, and hold harmless East Bay Notary Express, Mobile Notary & Apostille and its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to your provision of documents, misuse of our services, or any breach of these Terms and Conditions.

9. Governing Law

9.1 This Agreement shall be governed by the laws of the State of California, without regard to its conflict of law provisions.

9.2 In the event of any service issue or dispute, the Client agrees to provide the Company no less than fifteen (15) calendar days to review and remedy the matter before initiating a chargeback, legal action, or public complaint.

9.3 Any disputes that cannot be resolved amicably shall be resolved in the courts of Contra Costa County/California, before initiation of arbitration or litigation.

10. Acceptance

By submitting documents and payment for Services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.

11. Modification of Terms

We reserve the right to modify these Terms at our sole discretion at any time. The updated Terms will be effective immediately upon posting to our website. By continuing to use our services after any such modifications are posted, you agree to be bound by the revised Terms.

B. Terms and Conditions – Translation Services

These Terms and Conditions (“Agreement”) govern the provision of translation services (“Services”) by East Bay Notary Express, Mobile Notary & Apostille and any affiliated entity under the East Bay Notary Express, Mobile Notary & Apostille umbrella (“company”, “we,” “us,” or “our”) to the customer (“Client,” “you”). By submitting an order or payment for Services through any of our websites or other platforms, the customer (“you” or “Client”)  agrees to these terms outlined below.

1. Scope of Services

1.1 The Company provides professional certified document translation services in a strategic partnership with an ISO 9001:2015 accredited and ATA certified translation company.

1.2 All certified translations are issued with a Certificate of Translation on the translation department’s official letterhead.

1.3 Certified translations are issued electronically, with a wet signature provided upon request.
1.4 The Company may also offer optional services such as notarization, certification, and apostille processing, if requested and available.
1.5 The Company is not responsible for the legal effect, validity, or acceptance of translated documents by third parties or government entities unless explicitly confirmed in writing.

2. Accuracy and Limitations

2.1 Qualified translators complete all translations, and the Company takes reasonable care to ensure their accuracy and quality.
2.2 The Company does not guarantee word-for-word equivalence where language or cultural differences make this impractical.
2.3 The Client is responsible for reviewing the translation upon delivery and notifying the Company of any errors or omissions within five (5) business days. After this period, the translation will be deemed accepted.

3. Client Responsibilities

3.1 The Client must provide legible, complete, and accurate source documents by uploading them to our website at the time of order. 

3.2 The Client must clearly specify any special requirements (e.g., spelling of names, preferred terminology, formatting, partial translation requests) before work begins.
3.3 The Company will not be held responsible for delays or errors resulting from unclear, incomplete, or inaccurate source materials or instructions.

4. Fees and Payments

4.1 Service fees must be paid in full before translation begins, unless otherwise agreed to in writing.
4.2 Once work has started, fees are non-refundable, even if the Client cancels the order.
4.3 Additional fees may apply for urgent or specialized translations, formatting, certification, or shipping.
4.4 The Company reserves the right to withhold delivery of completed translations until payment is received in full.

5. Processing Time

5.1 Quoted turnaround times are estimates only and may vary depending on document length, complexity, and current workload.
5.2 The Company is not responsible for delays caused by factors beyond its control, including courier or postal delays, Client response time, or external agency processing.

6. Confidentiality

6.1 All documents submitted for translation are treated as confidential.
6.2 The Company will not disclose, copy, or share Client materials with any third party except as required to complete the translation or as required by law.

7. Liability

7.1 The Company’s liability is limited to the amount of fees paid for the specific translation in question.
7.2 The Company is not liable for indirect or consequential damages, including but not limited to lost profits, penalties, or delays caused by the use of translated materials.

8. Delivery

8.1 Translations are delivered electronically unless otherwise arranged.
8.2 If physical copies are requested, the Client is responsible for applicable shipping fees. The Company is not liable for loss, delay, or damage to documents once they are in transit.

9. Indemnifications

10. Affiliate and Partnership Disclosure

10.1 In accordance with the Federal Trade Commission’s 16 CFR Part 255: Guides Concerning the Use of Endorsements and Testimonials in Advertising, the Company hereby discloses that it maintains a strategic partnership with a certified translation company (the “Translation Partner”). The Company may receive compensation when the Client purchases translation services provided through this partnership. All translation services rendered by the Translation Partner are performed by qualified translators and are subject to the same standards of accuracy, confidentiality, and professional care observed by the Company.

11. Governing Law

10.1 This Agreement shall be governed by and construed under the laws of the State of California, without regard to conflict of law principles.
10.2 Any disputes shall be resolved in the courts of Contra Costa County/California.

12. Acceptance

By submitting a translation order, the Client confirms that they have read, understood, and agree to these Terms and Conditions.

13. Modification of Terms
